These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Merakiva Travel Inc (“we,” “us” or “our”), concerning your access to and use of the alwayssunnytour.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

 

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.

 

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.

Tour Details

 

Merakiva Travel Inc provides tour guide and travel services under the brand “Always Sunny Tour,” including but not limited to “It’s Always Sunny Walking Tour” (The Gang Goes to South Philly). Tours are restricted to individuals aged 16 and over, and purchases must be made by individuals aged 18 and over. There are no specific health or fitness requirements, but participants should be able to handle walking in urban environments. ADA compliance is limited to the compliance of Philadelphia’s streets.

 

Booking and Payment Methods

Preferred booking is online, and all major payment methods, including Apple Pay and Google Pay, are accepted via Stripe on the FareHarbor platform. Full payment is required at the time of booking; no deposits are necessary. Payments are processed in USD, and any currency conversion fees or discrepancies are the responsibility of the payment processor. Payment security is managed by FareHarbor, which adheres to industry-standard security protocols to protect your financial information.

 

Personal Data

We collect personal data such as name, phone number, and email through a third-party system managed by FareHarbor. This data is not used for marketing unless explicitly specified by you. Data sharing and storage are managed by FareHarbor's systems. By signing up for a tour, customers consent to being contacted via phone, email, and text regarding their bookings and tour information. Marketing communications are not automatically opted-in by purchasing a ticket.

 

Photographs and Videos

By participating in our tours, you consent to being photographed and filmed. Merakiva Travel Inc reserves the right to use these photographs and videos for commercial purposes, including but not limited to, on our website and on third-party sites such as social media platforms. If you do not wish to be photographed or filmed, please inform the tour guide at the start of the tour. We will make reasonable efforts to accommodate your request but cannot guarantee complete exclusion from all photos or videos taken during the tour.

 

Cancellations and Refunds

Customer Cancellations

• Up to seven days before the tour: 100% refund, contact hello@merakivatravel.com.

• Within seven days: No refund, but rescheduling is allowed.

 

Company Cancellations

The company may cancel tours due to unsafe weather or other conditions, providing either a refund or rescheduling option.

User Conduct

Users must not break any laws and must follow the advice and guidance of the tour guide during the tour. Engaging in illegal activities or any behavior that could harm the experience of others or damage the company’s property is prohibited. Specific conduct rules are at the discretion of the tour guide and are enforced to ensure the safety and enjoyment of all participants.

 

User Content

Users can post reviews on third-party sites, which we may share on our site. We have no control over the content on these third-party sites, but we reserve the right to share reviews that reflect the experiences of our tours. By posting reviews, users grant us the right to use, modify, and distribute the content in any media.

 

Intellectual Property

All content on the Site, including text, images, videos, and designs, is owned by Merakiva Travel Incorporated. We do not claim any intellectual property rights related to the show "It's Always Sunny in Philadelphia." Any references to the show are for descriptive purposes only and do not imply endorsement or affiliation.

Dispute Resolution

Any disputes arising from these Terms and Conditions will be resolved through mediation. Arbitration will take place in Philadelphia, Pennsylvania, and will follow the rules and procedures of the American Arbitration Association (AAA).

Modifications and Interruptions

Limitation of Liability

This includes, but is not limited to, damages resulting from data breaches, third-party services used during tours, or any other unforeseen incidents. Our total liability to you for any damages arising out of or related to these Terms and Conditions will not exceed the amount you paid to us for the specific tour in question.

These terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania. You agree to submit to the personal jurisdiction of the courts located within Philadelphia, Pennsylvania, for the resolution of any disputes.
